Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. It is submitted that the applicant has been roped in due to political vendetta and motivated action on the part of the police. The applicant has been in judicial custody since 23.10.2025 merely on the basis of suspicion, which, however strong, cannot take the place of proof. The allegations levelled against the applicant are false, baseless, and not reliable, and a bare perusal of the facts and circumstances of the case reveals that no prima facie case is made out against him. It is further submitted that the co-accused, namely Pawan Giri Goswami, has already been granted bail by this Hon’ble Court in M.Cr.C. No. 1197/2026 on 04.02.2026, and the present applicant is entitled to parity. The applicant is a respected person in his locality and has been made a scapegoat by the prosecution agency. Moreover, the trial is likely to take considerable time to conclude, and continued incarceration of the applicant would cause undue hardship. 4. On the other hand, learned State Counsel appearing for the
3 State/non-applicant opposes the bail application and submits that the present applicant, along with the co-accused, assaulted the injured with a knife, causing multiple injuries on the vital parts of his body. Hence, the applicant is not entitled to the grant of bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the present case, the nature and gravity of the offence alleged, and the material available on record, it is evident that the present applicant, in furtherance of a common intention along with the co-accused persons, assaulted the injured with a knife, thereby causing multiple injuries on the chest and other vital parts of the body. The medical evidence on record prima facie indicates that the injuries sustained by the injured are grievous in nature and were dangerous to life. In view of the seriousness of the allegations, the manner in which the offence has been committed, and the severity of the injuries inflicted, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7.
Therefore, the bail application filed by the applicant/accused – Bhuneshwar Giri Goswami involved in Crime No. 170/2025, registered at Police Station - Sargaon District – Mungeli (C.G.) for the offence punishable under Sections 109, 296, 115(2), 351(2) & 3(5) of BNS, is rejected.
