Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 81 of 2022, dated 25.10.2022, registered at Police Station Gaggal, District Kangra, H.P., for the commission of offences punishable under Sections 498A, 341 and 323 read with Section 34 of the Indian Penal Code (IPC) and consequential 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2026:HHC:21020 proceedings arising out of the said FIR based on the compromise effected between the parties. 2. It has been asserted that the matter has been compromised between the parties, and the informant and the victim do not want to proceed further with the matter after the compromise. Hence the petition. 3. Statements of the informant Binta Devi and victim Vishali Choudhary were recorded on 26.2.2026, in which they stated that they had entered into a compromise voluntarily without any influence from any person. They have no objection to quashing the FIR based on the compromise. 4. The offences punishable under Sections 341 and 323 of IPC are compoundable under Section 320 of Cr.P.C. Section 320(3) of Cr.P.C. provides that where an offence is compoundable under this Section, and the accused is liable under Section 34 or 149 of IPC, the offence may be compounded. Therefore, the offence punishable under Sections 341 and 323 read with Section 34 of the IPC can be compounded based on the compromise. An FIR registered for the commission of an offence punishable under Section 498A of the IPC can be quashed based on the compromise

Consequently, the present petition is allowed and FIR No. 81 of 2022, dated 25.10.2022, registered at Police Station Gaggal, District Kangra, H.P., for the commission of offences punishable under Sections 498A, 341 and 323 read with Section 34 of IPC and consequential proceedings pending/initiated against the petitioner-accused in pursuance thereto are quashed. 6. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 7. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
