This is an application filed by the applicant Shri Yijum Bagra under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking grant of pre- arrest bail apprehending his arrest in connection with Aalo P.S. Case No. 21/2026 registered under Sections 318(2)/336(3)/338/340(2) of the Bharatiya Page No.# 2/3 Nyaya Sanhita, 2023. 3. The case of the applicant is that based on a written First Information Report (FIR) lodged by one Shri Kenli Nyorak before the Officer-in-Charge, Aalo Police Station, on 24.05.2026, against M/s. NRK Agency, alleging, inter alia, commission of cheating, fraud, forgery, and criminal conspiracy in connection with Press Notice No. EEA/RWD/NIT-20/2025-2026 dated 12.03.2026, relating to construction of RLR from Lipu Jeyi Road to Pigi Menggo Region at Bagra under Aalo, West Siang District, Arunachal Pradesh; the aforesaid police case has been registered. 4. The petitioner was granted interim pre-arrest bail on 10.07.2026 upon conditions. 5. In the meantime, the scanned copy of the Case Diary has been received. 6. Mr. Kato, learned counsel for the petitioner, submits that the petitioner has appeared before the Investigating Officer as many as four times and pursuant to the grant of interim pre-arrest bail, he again appeared before the Investigating Officer. It is further submitted on behalf of the petitioner that he has handed over the electronic materials to the Investigating Officer. 7. In terms of the order passed by this Court, a status report has been submitted by the Investigating Officer. 8. From the status report, it is seen that some incriminating materials have been revealed against the petitioner, inasmuch as the forensic examination indicates that the handwriting matches that of the petitioner and that the seal found on the concerned documents is not original. 9. Though the investigation has revealed some incriminating materials against the petitioner, nevertheless, considering the fact that he has appeared before Page No.# 3/3 the Investigating Officer on multiple occasions, including pursuant to the order granting interim pre-arrest bail, this Court is of the considered view that it may not be necessary to cancel the interim bail. 10. In such view of the matter, the interim pre-arrest bail granted vide order dated 10.07.2026 is hereby made absolute, subject to the following conditions: i. that the accused petitioner shall render full cooperation with the investigation; and ii. that the accused petitioner shall not try to hamper or tamper with the evidence. 11. Violation of any of the above bail conditions shall entail cancellation of the bail. 12. The anticipatory bail application stands allowed and disposed of.
