Heard Mr. C. Gogoi, the learned counsel appearing on behalf of the Petitioner and Ms. A. Gayan, the learned CGC appearing on behalf of the Respondent No.1. 2. The Petitioner herein who is an account holder of a Savings Bank Account bearing Account No.40963011690 with the State Bank of India, Jagiroad Branch is aggrieved by the freezing of the Bank Account on the basis of an instructions received from the Police Cyber Cell, Bihar in connection with NCRP Cyber Complaint No.30509250065496 dated 25.09.2025 with respect to the alleged credit of a disputed transaction amount of Rs.12,000/- dated 25.09.2025. The Petitioner thereupon submitted legal notice and representation to the Respondent Nos. 2 and 3 however, the said legal notice and the representation having not been acted upon, the Petitioner has approached this Court by filing the present writ petition seeking a direction that the disputed amount may be kept in hold thereby permitting the Petitioner to operate the Bank Account. 3. Page No.# 3/4 Coordination Centre of the Ministry of Home Affairs have issued a Standard Operating Procedure (SOP) for NCRP-CFCFRMS, Custody, Restoration of money and Grievance Redresssal dated
02.01.2026. At Section III of the SOP, the Grievance Redressal Mechanism has been categorically mentioned. 4. Taking into account that there is a grievance mechanism set up in view of the Standard Operating Procedure (SOP) for NCRP-CFCFRMS, Custody, Restoration of Money and Grievance Redresssal dated 02.01.2026 issued by the Ministry of Home Affairs, it is the opinion of this Court that the Petitioner would be well advised to approach the Grievance Redressal Mechanism set out in the SOP dated 02.01.2026. 5.
Accordingly, without prejudice to the Petitioner’s claims made in the instant writ petition, this Court is not inclined to entertain the instant writ petition thereby granting liberty to the Petitioner to approach Grievance Redressal Mechanism in terms with the SOP dated 02.01.2026. 6. It is further observed and directed that if the Petitioner approaches in terms with the provisions stipulated in Section III of the SOP dated 02.01.2026, the concerned Authority shall duly take steps in accordance with the said mechanism.
