M/L 566. 06-02-2026 CRM (DB) 2723 of 2024 (ct. no.35) S. De 265777 In Re: An application under Section 439 (2) of the Code of Criminal Procedure. And In the matter of : Jahed Mallick @ Zahed Mallik. …Petitioner. Mr. Navanil De, Mr. Srinjan Ghosh, Mr. Subhrajit Dey, …for the petitioner. Ms. Faria Hossain, Ld. APP, Mr. Saibal Krishna Dasgupta, …for the State. Mr. Amitava Karmakar, …for the opposite party no.2. Report submitted by the State, be kept with the records. Learned advocate for the petitioner submits that because of certain supervening circumstances at the relevant period of time, the application for cancellation of bail was preferred before this Court. Learned advocate for the State submits a report. The report reflects that on the basis of the information submitted, Egra P.S. case no. 449 of 2024 was registered for investigation. Having considered that the police authorities have already taken steps and the incident complained of is more than one and the half year ago, I am of the view that at this stage no interference is called for. But if the accused persons repeat their conduct, the learned Trial Court would seriously consider the liberty granted to the accused persons since offences complained of are under Sections 498A and 334 of the Indian Penal code. If there are any issues regarding tampering of the evidence and/or threatening the witnesses 2 of the case, the petitioner would be at liberty to take out an appropriate application before the learned Court in seisin of the case. The learned Court would in such circumstances either impose conditions or interfere with the liberty granted in accordance with the provisions of law. Accordingly, CRM (SB) 2723 of 2024 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of the order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
