District Education Officer (Elementary), Haridwar has deferred the decision on application submitted by petitioner for reemployment till end of academic session and called a report from Deputy Education Officer, Bhagwanpur. 3. The reason assigned for deferring the decision is that Deputy Education Officer, in his report had mentioned that no writ petition filed by petitioner is pending. 4. Petitioner submits that he had to file a writ petition against order of recovery passed by Deputy Education Officer and the said writ petition is pending and interim order has been granted against recovery order. 5. He submits that filing of writ petition cannot be a disqualification for reemployment. He further submits that since decision is yet to be taken by District Education Officer, therefore he be directed to take decision at the earliest. 6. The writ petition is, accordingly, disposed 2026:UHC:303 of with a direction to the District Education Officer concerned to take decision in the matter within three weeks from date of presentation of certified copy of this order.
