PUBLIC PROSECUTOR 2 The Court made the following ORDER: This Criminal Petition is filed by the Petitioners/A.1 and A.2 under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS, 2023”) seeking to release them in the event of their arrest in connection with unregistered Crime Number of 2026 of KKoduru PoliceStation, YSR Kadapa Police District. Heard Sri K.Viswanatham, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for respondent State. Perused the material on record. Learned counsel for the Petitioners would submit that the petitioners herein are arrayed as A.1 and A.2 and they are apprehending arrest in the hands of the Police and in anticipation of the same, they filed the present criminal petition. Further, the de facto Complainant is the own sister of the petitioner No.1. The Petitioner No.1 is the wife of the Petitioner No.2. Petitioner No.2 is working as a Senior Manager in HDFC Bank. The Police are calling the Petitioners to the Police Station in the unregistered crime. Earlier, the de facto Complainant approached the Superintendent of Police and submitted an application in Public Grievances Redressal Cell. Learned counsel would further submit that the parents’ of the Petitioner No.1 and the de facto Complainant are no more. There is an apprehension of arrest of the Petitioners in the hands of 3 police. On the complaint made by the sister(Smt.Gurram Anuradha) of the Petitioner No.1, there is likelyhood to register any case against them. On the other hand, learned Assistant Public Prosecutor, on instructions, would submit that on a private complaint lodged by one Smt.Gurram Anuradha, which was forwarded by the Police for registration of crime. The police registered a crime against the Petitioners, arraying them as A.1 and A.2 for the offences punishable under Sections 303(2) read with 3(5) of BNS, 2023. Learned Assistant Public Prosecutor would further submit that the Police might have called the Petitioners for serving notice under Section 35(3) BNSS, 2023. At this juncture, learned counsel for the Petitioners would submit that recording the said submissions, this Criminal Petition may be disposed of. Considering the submissions made, though this criminal Petition is filed seeking anticipatory bail in an unregistered crime, it is brought to the notice that a crime has been registered against the Petitioners. The learned Assistant Public Prosecutor would submit that the police called the petitioners for service of notice under Section 35(3) BNSS, 2023. Accordingly, this Criminal Petition is disposed of.
