Mrs. Sabita Khutia (Bhuinya), Ms. Arpita Saha …for the Petitioner. Mrs. Susmita Biswas Chowdhury …for the State. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks for disbursement of family pension in her favour. 3. The petitioner contends that the father of petitioner, late Kamakshya Charan Mallick was an Assistant Teacher in the district of Hooghly at Khanakul. After discharging for more than 33 years of satisfactory qualifying service the petitioner’s father retired from service on superannuation on 31st December, 1982. The petitioner’s father died on 9th January, 1992. The Pension Payment Order was issued in favour of the petitioner’s mother on 28th January, 1994. The mother of the petitioner died on 19th August, 2020. The husband of the petitioner died on 10th November, 1979. The petitioner is the widowed daughter of the 2 deceased employee. On 21st July, 2025, the petitioner made a representation before the appropriate authority for grant of family pension. However, the same is still pending with the authority. Hence, this writ petition. 4. Ms. Arpita Saha, learned Advocate appearing for the petitioner submits that the representation of the petitioner be relegated to the appropriate authority for consideration and disposal. 5. Despite service, none appears on behalf of the State. 6. Mrs. Susmita Biswas Chowdhury, learned Advocate, who usually appears on behalf of the State- respondents is requested to appear in this matter. The appearance of Mrs. Chowdhury be regularised by the concerned authority. 7. Let a copy of the writ petition along with its annexure be served upon Mrs. Chowdhury, learned Advocate for the State respondents. 8. Mrs. Chowdhury, learned Advocate for the State also submits that the matter be relegated to the appropriate authority. 9. In view of such submissions, the respondent No.4, District Inspector of Schools (P.E.), Hooghly is directed to consider the representation of the petitioner dated 21st July, 2025 in accordance with law, upon notice to the petitioner, within a period of eight weeks from the date of communication of this order and dispose of the same by passing a reasoned 3 order. The reasoned order shall be communicated to the petitioner within a week from the date of passing of such order. 10. Learned Advocate for the petitioner is directed to communicate this order to the respondent No.4, for necessary compliance. 11. With the aforesaid direction, the writ petition being WPA 25667 of 2025 stands disposed of. 12. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 13. Interim order, if any, stands vacated. 14. All connected applications, if any, stand disposed of. 15. There shall be no order as to costs. 16.
