The petitioner is apprehending his arrest in connection with Balumath P.S. Case No. 128/2025, registered under sections 338, 336(3), 340(2), 303(2), 317(5) of BNS and section 21 of MMDR Act and Rule 13 of JM (PIMTS), Rules, 2017, pending in the Court of learned Chief Judicial Magistrate, Latehar. 3. Learned counsel for the petitioner submits that petitioner is owner-cum-driver of the truck in question and allegation is made that on the basis of loading slip provided by one Jitendra Kumar, coal was loaded and petitioner has got no criminal antecedent which is disclosed in para 6 of the petition. He further submits that in identical situation co-accused has been granted anticipatory bail in A.B.A. No. 7209 of 2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that without loading slip coal was loaded. 5. Considering that petitioner is owner-cum-driver of the truck in question, he has got no criminal antecedent which is disclosed in para 6 of ( 2026:JHHC:3026 ) the petition, co-accused has been granted anticipatory bail in the aforesaid A.B.A and it has been pointed out that on the basis of loading slip provided by one Jitendra Kumar, coal was loaded, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Balumath P.S.
