2. Petitioner was appointed as Assistant Teacher (LT Grade) in Kumaon Region. Pursuant to a decision taken by State Government, petitioner applied for transfer in another region. Her request was accepted and she was transferred to Garhwal Region vide
order dated 09.04.2025, passed by Additional Director of Education, Pauri. However, by the said order, petitioner was posted at Chakrata, District Dehradun.

Petitioner has challenged her transfer to Chakrata on the ground that she suffers from locomotive disability and her disability is to the extent of 40%, therefore, she is entitled to certain benefits, which are available to person with physical disabilities, as per the provisions of the Parliamentary Legislation.
4. A coordinate Bench of this Court passed an interim order in favour of petitioner on 02.06.2025 whereby the operation of the transfer order was stayed.

Learned counsel for the petitioner submits that pursuant to the interim order of this Court, petitioner is still continuing at Dewayal, Almora in Kumaon Region. He submits that petitioner is willing to serve in Garhwal Region where her entire family is residing; however, on account her transfer to inaccessible place, petitioner was unable to join duties.
6. Learned State Counsel submits that if petitioner is unhappy with her posting at Chakrata (Dehradun), then she could have approached the competent authority by making a representation.
7. The writ petition is, therefore, disposed of with liberty to petitioner to make fresh representation regarding her posting. If she makes such representation to the Regional Additional Director, Pauri within two weeks from today, decision thereupon shall be taken, as per law, within eight weeks thereafter.
8. For a period of ten weeks or till decision is taken, whichever is earlier, protection granted to her by coordinate Bench shall continue.
