1. Heard Mr. Sudhir Kumar Roy, learned counsel for the appellant and learned A.P.P.
2. This appeal is directed against the order dated 03.12.2025 passed by the learned Additional Sessions Judge-IX, Giridih in A.B.P. No. 2158/2025 in connection with Jamua P.S. Case No. 244/2025, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.
3. It has been alleged that one Nitin Kumar and Abhishek Kumar Rana were apprehended by the police and from the possession of Abhishek Kumar Rana fake currency notes of 500 denomination were recovered.
4. Submission has been advanced by the learned counsel for the appellant that appellant has been implicated on the confessional statement of Abhishek Kumar Rana.
5. It has further been submitted that Nitin Kumar, who was the person, who was apprehended at the spot, has been granted regular bail in Cr. Appeal (DB) No. 105 of 2026.

6. Learned A.P.P. has opposed the prayer for bail of the appellant and on perusal of the case diary, he has submitted that the only incriminating factor against the appellant seems to be the confessional statement of Abhishek Kumar Rana.
7. Regard being had to the above, we, while setting aside the order dated 03.12.2025 passed by learned Additional Sessions Judge-IX, Giridih in A.B.P. No. 2158 of 2025, arising out of Jamua P.S. Case No. 244 of 2025, direct the appellant, above named, to surrender before the learned trial court within a period of four weeks and on his surrender, the learned trial court shall release him on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih in connection with Jamua P.S. Case No. 244 of 2025 subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
8. This appeal is allowed.
