NATARAJ ORAL JUDGMENT This appeal is filed by the defendant in O.S.No.6174/2017 on the file of the V Additional City Civil and Sessions Judge, Bengaluru, challenging the judgment and decree dated 14.02.2024 by which, the suit for recovery of money was decreed in part and the defendant was ordered to pay a sum of Rs.3,72,129/- along with interest at the rate of 6% per annum. 2. When this appeal is listed for final hearing, a joint memo is filed by the learned counsel for the appellant and the learned counsel for the respondent, in terms of which, the appellant and the respondent have agreed to settle the dispute. The appellant has agreed to pay a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only), while the respondent has agreed to accept the same towards full and final settlement of all its claim under the decree in O.S.No.6174/2017. It is submitted that the appellant has transferred a sum of - 3 - HC-KAR NC: 2026:KHC:15160 RFA No. 1125 of 2024 Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) to the respondent. 3. The joint memo is taken on record. 4. In view of the joint memo, this appeal as well as the suit filed by the plaintiff in O.S.No.6174/2017 on the file of the V Additional City Civil and Sessions Judge, Bengaluru, stand disposed of. 5. Office is directed to refund the Court fee as per the judgment of the Hon'ble Apex Court in the case of High Court of Judicature at Madras vs. M.C. Subramaniam and others [AIR 2021 SC 2662]. 6.
