Case No. 186 of 2024 dated 14.10.2024 under Sections 103/238/3(5) of the BNSS, 2023 and Section 25/27 of Arms Act. And In the matter of : Asim Mondal ……Petitioner. Mr. Asraf Mondal Mr. Kaushik Ghosh ……for the Petitioner. Ms. Baisali Basu Mrs. Manasi Roy ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year and 3 months and similarly placed accused person has been granted bail in CRM (M) 1846 of 2025. Learned advocate for the State opposes the prayer for bail and submits that the present petitioner namely, Asim Mondal is differently situated than the person who has been granted bail, while the facts reveal that Mikail Sk., the person who has been granted bail was guarding the place of occurrence. 2 On the other hand, the present petitioner was holding the deceased when he was assaulted by sharp cutting weapon by the principal accused. Having regard to the complicity of the present petitioner and the fact that witness action is about to commence, at this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 2002 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
