PUBLIC PROSECUTOR 2 The Court made the following ORDER: This Criminal Petition is filed by the Petitioners/A.2 and A.3 under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS, 2023”) seeking to release them in the event of their arrest in connection with Crime No.101 of 2026 of East Police Station, Tirupati, registered for the offences punishable under Sections 61(2), 305(a), 318(4), 351(2) read with 3(5) of BNS. Heard Smt.Kalla Tulasi Durgamba, learned counsel for the Petitioners who appeared through video conferencing and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for respondent State. Perused the material on record. Learned counsel for the Petitioners would submit that the petitioners herein are arrayed as A.2 and A.3 and they are falsely implicated in this crime. Further, without conducting any preliminary enquiry and without ascertaining the true facts of the case, the respondent Police illegally implicated the Petitioners. Learned counsel would further submit that there is no substantial material to show the involvement of the Petitioners in this case. Prima facie there are no ingredients attracting the offences lodged against the petitioners. Learned Assistant Public Prosecutor on instructions brought to the notice of this Court that there are no reasons believing that there is a threat of arrest against the Petitioners and that the respondent Police have already served notice under Section 35(3) BNSS, 2023 to the Petitioners. 3 Learned counsel for the Petitioners would submit that recording the said submission, this criminal petition may be disposed of. Considering the submissions made, this Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
