1. Heard Mr. Gautam Kumar, learned counsel for the appellant and learned A.P.P.
2. This appeal is directed against the order dated 07.04.2026 passed in Misc. Criminal Application No.111 of 2026 arising out of Pakuria P.S. Case No.35 of 2025 by learned Additional Sessions Judge-I, Pakur, whereby and whereunder the prayer for bail of the appellant has been rejected.
3. It has been alleged that the appellant was apprehended by the police and from his possession two 500 rupees and two 100 rupees counterfeit notes were recovered.
4. Submission has been advanced by learned counsel for the appellant that the appellant is in custody since 20.07.2025. It has further been submitted that one of the co-accused Badshah Khan has been granted bail by this Court in Cr. Appeal (DB) No.165 of 2026.
5. Learned A.P.P. has opposed the prayer for bail of the appellant.
6. Regard being had to the period of custody undergone by the appellant, we while setting aside the order dated 07.04.2026 passed in Misc. Criminal Application No.111 of 2026 arising out of Pakuria P.S. Case No.35 of 2025 by learned Additional Sessions Judge-I, Pakur, direct that the appellant be released on
2026:JHHC:13066-DB bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Pakur in connection with Pakuria P.S. Case No.35 of 2025.
7. Accordingly, this appeal is allowed.
