1. The instant bail applications under Section 483 B.N.S.S. have been filed by the petitioners in connection with the impugned FIR
[2026:RJ-JP:13369] (2 of 3) [CRLMB-3535/2026] No. 19/2026 registered with the Police Station Kotwali Bundi, District Bundi for the offence punishable under Section(s) 303(2), 317(2) B.N.S., 2023.

Learned counsel for the petitioners submits that as per the case of prosecution, allegations levelled against the accused is that he committed theft of AC copper pipes, which have been recovered from open place. Counsel appearing on behalf of the accused-Sabir submits that in fact no allegations of committing theft were levelled against him, rather allegations have been levelled against him for receiving the stolen AC pipes. He further submits that the alleged offences are triable by the Judicial Magistrate and after investigation charge-sheet has been submitted against the petitioners and the trial will take its own time to conclude, therefore, indulgence of bail may be granted to the petitioners. 4. Per contra, learned Public Prosecutor opposes the bail applications and submits that the petitioners are habitual offenders and are in habit to commit the same offences. Hence, under these circumstances the petitioners are not entitled to get the indulgence of bail and their bail applications are liable to be rejected. 5. Heard and considered the submissions made at Bar and perused the material available on record. 6. Considering the arguments put forward by counsel for the petitioners and looking to the fact that the recovery of AC pipes has been made from an open place and also looking to the fact that the accused-petitioners namely, Sabir, Sonu Dagar Alias Sonu Kumar Urf Gulaba, Ravi Boyat @ Golu Chadda and Suraj @ Chundi
[2026:RJ-JP:13369] (3 of 3) [CRLMB-3535/2026] are in custody since 13.02.2026, 16.01.2026, 16.01.2026 & 18.01.2026 respectively. After investigation, charge-sheet has already been submitted and the alleged offences are triable by Judicial Magistrate and since the trial will take its own time to conclude, without expressing any opinion on merits or demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the accused-petitioners under Section 483 BNSS. 7.
Accordingly, the instant bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners Sabir S/o Raseed, Sonu Dagar Alias Sonu Kumar Urf Gulaba S/o Kalulal, Ravi Boyat @ Golu Chadda and Suraj @ Chundi S/o Bablu arrested in connection with the aforementioned FIR, may be released on bail; provided each of them shall furnish personal bond of Rs.50,000/- each along with two surety bonds of Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all the dates of hearing, as and when called upon to do so. 8. It is made clear that in case the petitioners get themselves involved in committing and repeating the same kind of offences and in case any FIR is registered against them, in future, then in such eventuality the learned Public Prosecutor as well as the Investigating Officer would be at liberty to file an application for cancellation of their bails.
