W.P.(C) 8381/2026 3. The present Petition, filed under Articles 226 & 227 of the Constitution of India, seeks the following reliefs: “..... a. Set aside/ modify the order dated 22.06.2026 passed by Ld. Appellate Authority, North District, Rohini Court, Delhi in PPA No. 02/2025 titled “Bharat Khandelwal Vs. DDA"; b. Set aside/ quash the notice(s) dated 11.06.2026 and 17.06.2026 issued by Executive Engineer, RMD-8/DDA, directing the Petitioner to vacate the subject property bearing Flat No. 58, Block D, Pocket 5, Sector-15, Rohini, Delhi-110085; c. Restore the possession of Flat No. 58, Block D-5, Sector-15, Rohini, Delhi in favour of the Petitioner and restoration of status quo ante as existing prior to 23.06.2026, pending disposal of PPA No. 02/2025 titled "Bharat Khandelwal Vs. DDA" in accordance with law; and, e. Pass such other or further order(s) as this Hon'ble court may deem fit and proper in the facts and circumstances of the present case.” 4. Issue Notice. 5. Mr. Pranay, Advocate, appearing on advance service, accepts notice on behalf of the Respondent. 6. Learned counsel appearing on behalf of the parties are ad idem that the Appeal, being PPA No. 02/2025, against the Eviction Order dated 26.12.2024, is listed before the learned Appellate Authority on 10.07.2026. 7. Learned counsel for the Respondent further submits that the Petitioner has already been dispossessed from the property on 23.06.2026. Learned counsel for the Petitioner concurs with the aforesaid submission. 8. Learned counsel appearing on behalf of the Petitioner however submits that the Petitioner is currently rendered homeless and has no place to stay, and therefore be granted the aforesaid reliefs. 9. This Court is of the considered view that since the learned Appellate Authority is already in sesin of the substantive dispute and the matter is to be considered on 10.07.2026, it would be inappropriate for this Court to invoke its extraordinary jurisdiction under Article 226 of the Constitution of India to grant an interim relief restoring possession at this stage.
