JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer. “Wherefore, the petitioner respectfully prays this Hon’ble Court to be pleased to;- i. To issue a Writ of mandamus or any other writ, order or direction, directing the respondent Nos.1 to 4 to consider representation dated 03.10.2022 of the petitioner placed at Annexure-G, of requesting respondent Nos.1 to 4 to stop from illegally forming road over the land of the petitioner without due process of law and in utter violation of principles of natural justice. Further be pleased to order for initiation of appropriate action against the respondent Nos.2 to 4 for illegal acts and attempts of forming road in the private fertile land of the petitioner and to; - 3 - HC-KAR NC: 2026:KHC:23385 WP No. 21744 of 2022 ii. Grant such other relief or relief’s as this Hon’ble Court deems fit and proper to grant in the circumstances of the case, together with cost, in the interest of justice and equity.” 2. It is the case of the writ petitioner that petitioner is the absolute owner of Sy.No.311, an extent of 4 acres 20 guntas with Karab of 1 acre 16 guntas and land in Sy.No.309 of an extent of 4 acres 7 guntas with Karab of 1 acre 4 guntas situated at Ammanibyrasagara Village, Kasaba Hobli, Gudibande Taluk. The petitioner as acquired the same by virtue of Will executed by his mother dated 10.05.2002. Subsequent to death of his mother, the petitioner has become the absolute owner of the property and all the revenue records are mutated in the name of the petitioner. It is the grievance of the petitioner that the respondents without following due process of law are laying the road in the petitioner's land and he has given a representation to the respondents on 03.10.2022 stating that the respondents cannot lay the road in the petitioner's land and as the same was not considered and they are proceeding with laying of the road, the petitioner has come before the Court. 3. Learned AGA appearing on behalf of the respondents submits the land belongs to the Government and it - 4 - HC-KAR NC: 2026:KHC:23385 WP No. 21744 of 2022 is not the petitioner's land. Further it is submitted that respondents have not laid the road so far. 4. Considering the submission made by learned AGA and the fact that the road is not laid so far, this Court deems it appropriate to pass the following: ORDER i. Accordingly, the writ petition is disposed of directing the respondents to consider representation date 03.10.2022 in accordance with law within a period of four weeks from the date of receipt of the copy of the order. ii. Till such time the respondents shall not lay the road in the petitioner's land without due process of law iii. All pending I.As., in the writ petition shall stand closed.
