This is an application filed under Section 483 of the BNSS, 2023 for granting bail to the accused, who were arrested on 27.06.2026 in connection with Jalukbari Police Station Case No. 231/2026 under Section 61(2)/179/180/182/112 of the BNS, 2023. 3. On 28.06.2026, the complainant namely Abhisek Saikia, SI(P), lodged a written FIR before the Officer-in-Charge, Jalukbari Police Station, stating that on 28.06.2026, the In-Charge of Jalukbari Out Post received information from a reliable source that a few persons were engaged in the printing, manufacturing, possession and circulation of Fake Indian Currency Notes (FICN) at Millennium Garden Apartment under the jurisdiction of Jalukbari Out Post. Acting upon such information, a police team proceeded to the spot and intercepted three persons, namely, Md. Jiarul Hoque, Md. Annas Alia and Md.Rahim Miya. Page No.# 3/4 4. It was alleged that during the search operation, four vehicles, namely, a Scorpio bearing registration No. AS01GN0750, a Suzuki Baleno bearing registration No. AS01FZ5860, a Tata Nexon bearing registration No. AS01GA2130 and an Alto K10 bearing registration No. AS01TL0910, were searched and seized. The police allegedly recovered 558 suspected fake indian currency notes of Rs.500 denomination having a face value of Rs. 2,79,000/- along with six other suspected fake Rs.500 denomination notes from the dickey of the Alto K10 vehicle. Certain mobile phones were also allegedly recovered from the vehicles as well as from the possession of the apprehended persons. 5. The FIR further states that during interrogation, the apprehended persons allegedly disclosed that the seized counterfeit currency notes had been printed and manufactured in Room No. A1D5, Millennium Garden Apartment, which had allegedly been taken on rent by Islam Ali @ Sahil and his wife Sumi Borah. Pursuant to such disclosure, the police conducted a search of the said room and allegedly recovered various articles suspected to have been used for manufacturing counterfeit currency notes, including printers, a laptop, printer inks, printed sheets containing images of Rs.500 denomination notes, black papers, chemicals, a paper trimmer machine, bond papers and suspected fake currency notes. 6. It is submitted by the learned counsel for the petitioners that the vehicle from which the fake Indian currency notes were recovered did not belong to the petitioners, who were construction workers who had gone to the PO to do some work in the apartment belonging to the main absconding accused, Islam Ali @ Sahil and Sumi Borah. Moreover, nothing was recovered from the possession of the present petitioners, and having regard to their period of detention of about 28 days, the petitioners may be released on bail. 7. The learned Additional Public Prosecutor submits with reference to the Case Diary that there are sufficient incriminating materials against all the accused, including the petitioner, who were working Page No.# 4/4 together with the main absconding accused persons, and that they were involved in the distribution of fake Indian currency notes. Moreover, it appears from the Case Diary that there is a whatsapp group consisting of the petitioners and the absconding accused persons, and the screenshots of the whatsapp messages of the said group indicate the clear involvement of the petitioners, in addition to their own statements in which they have clearly stated their role in the circulation of the fake Indian currency notes. 8. It is also submitted that on the basis of the statements of the petitioners, the police searched the apartment of the absconding accused upon being led by the present petitioners, and recovered incriminating materials like printers, a laptop, printer ink, as well as fake Indian currency notes, which have been mentioned in the seizure list. Such statements of the petitioners are admissible in evidence under Section 27 of the Evidence Act and, therefore, the same can be taken into consideration while deciding the question of bail. 9. There appears to be force in the submission of the learned Additional Public Prosecutor, inasmuch as, in addition to the petitioners' own statements, the same has led to the discovery of incriminating material as aforesaid. 10. Having regard to the seriousness of the allegations and the incriminating materials available against the petitioners, the prayer for bail stands rejected at this stage. JUDGE Comparing Assistant
