These instant bail applications under Section 483 B.N.S.S. have been filed by the petitioners in connection with the impugned FIR No. 430/2025 registered with the Police Station Udoyog Nagar (Kota City), District Kota City for the offences punishable under Section(s) 115(2), 126(2), 109(1), 324(4), 333, 189(2) of B.N.S., 2023 & 3(2)(va) of the SC/ST (Prevention of Atrocities) Act, 1989. 2. Learned counsel for the petitioners submits that none of the injured have sustained any grievous/dangerous to life injury on any vital part of their bodies but two injured have sustained grievous injuries on non-vital parts of their bodies i.e. hands. After investigation, charge-sheet has been submitted against the petitioners. The petitioners are in custody since 27.10.2025 and the trial will take its own time to conclude, therefore, indulgence of bail may be granted to the petitioners. 4. Per contra, learned Public Prosecutor opposes the bail applications. 5. Heard and considered the submissions made at Bar and perused the material available on record. 6. Considering the arguments put forward by counsel for the petitioners and looking to the fact that none of the injured have sustained any grievous/dangerous to life injury on any vital part of their bodies however, two injured have sustained grievous injuries [2026:RJ-JP:13378] (4 of 4) [CRLMB-3593/2026] on non-vital parts of their bodies i.e. hands. The petitioners are in custody since 27.10.2025, charge-sheet has already been submitted and the trial will take its own time to conclude, without expressing any opinion on merits or demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the accused-petitioners under Section 483 BNSS. 7. Accordingly, these instant bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners Pawan Verma S/o Late Shri Dhanraj, Mohit Pankaj S/o Ramkishan, Akash Gurjar S/o Jagdish Gurjar, Mohit Pankaj S/o Ramgopal, Kapil Verma S/o Late Shri Dhannalal, Shubham Verma S/o Sh. Prabhulal & Sonu Meghwal @ Gappi S/o Sh. Rajmal Meghwal arrested in connection with the aforementioned FIR, may be released on bail; provided each of them shall furnish a personal bond of Rs.50,000/- each along with two surety bonds of Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all the dates of hearing, as and when called upon to do so.
