Suresh Kumar Counsel for the Respondent: Mr. K M KRISHNA REDDY NJS,J C.C No.2066 of 2025 2 THE HONOURABLE SRI JUSTICE NINALA JAYASURYA Contempt Case No:2066 of 2025 The Court made the following Order: Heard Mr. B.Subramanya Kumar, learned counsel representing learned counsel for the petitioners. Also heard Mr. K.M.Krishna Reddy, learned Government Pleader representing the respondent. 2. Contempt Case is filed alleging violation of the interim orders dated 03.11.2022 in Writ Petition No:35614 of 2022, the operative portion of which reads as follows: “Considering the submissions made that the petitioners filed O.S.N0.24 Of 2022 on the file Of the Court of VI Additional District Judge, Machilipatnam and order of injunction was granted in I.A. No.306 of 2022, dated 21.10.2022, and mentioning the said aspects a representation was made on 21.10.2022 to respondent No.4, there shall be a direction to respondent Nos.2 to 4 not to mutate the names of unofficial respondents in respect of the subject matter land without considering their representation and without giving due opportunity to them.” 3. This Court after issuing notice to the respondent, on 22.01.2026, admitted the Contempt Case, observing inter alia as follows: “…The explanation of respondents in Para-9 of the reply affidavit that the party respondents to the writ petition have not brought to his notice about the interim stay orders dated 03.11.2022 and due to inadvertence mutation of names of the unofficial respondents was effected, cannot be accepted, more particularly when he is a party respondent to the writ petition. Further as seen from the endorsement dated 04.11.2022 his predecessor had clearly mentioned that action of mutation would be taken after delivery of the court orders...” NJS,J C.C No.2066 of 2025 3 4. Thereafter, on 24.06.2026, respondent filed an affidavit stating inter alia as follows: “10. I respectfully submit that after knowing the fact, that there was interim orders operating by ths Hon’ble Court vide orders dated 03.11.2022, I have immediately informed my successor Tahsildar, Nagayalanka to cancel the mutation entries in respect of Bavireddy Ravindra, R/o. Nangegadda Village and Bavireddy Venkateswara Rao, R/o. Nangegadda Village. I submit that my successor had taken immediate action and put it in disputed register until final orders of the Hon’ble Court orders. Now the entire subject land was restored as it is. I submit that this respondents maintaining the stay orders dated 03.11.2022. I submit that my successor has taken action as per interim orders of the Hon’ble Court. Presently the subject was restored as it is.” 5. Though submission of learned counsel for the petitioners that the interim order dated 03.11.2022 is not implemented in true letter and spirit, and respondent is liable for punishment merits appreciation, considering the submission made by Mr. K.M.Krishna Rao, learned Government Pleader, and perusing the material filed along with the affidavit filed on 24.06.2026, this Court is inclined to close the Contempt Case, as the incumbent Tahsildar has mutated the names of the original owner of the land, with whom the petitioners herein appear to have entered into agreement of sale. 6. It is also pertinent to note that to the affidavit filed on 24.06.2026, no rejoinder is filed. 7. In the aforementioned circumstances, this Contempt Case is closed. No costs.
