1. The petitioner, who is the complainant in FIR No. 139/2018 for offences under Section 63 of the Copyright Act, 1957 and Sections 103 and 104 of the Trade Marks Act, 1999 registered at police station Economic Offences Wing, Delhi seeking quashment of the said FIR on the ground of expressing remorse and undertaking furnished by the accused to cease from any infringing activities.
2. The Court has considered the facts and circumstances and has also perused the FIR in question. It appears that the offence has arisen from the commercial activities.
3. If the petitioner himself does not want to continue with the aforesaid FIR, it can not be taken to its logical conclusion. As has been stated by the petitioner, on expressing remorse by the accused persons, the petitioner does This is a digitally signed order. Bearing in mind the aforesaid facts and circumstances of the case, the FIR No. 139/2018 for the offence under Section 63 of the Copyright Act, 1957 and Sections 103 and 104 of the Trade Marks Act, 1999 registered at police station Economic Offences Wing, Delhi Police, and all consequential actions pursuant thereto, stand quashed.
