Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 26 of 2022, dated 15.2.2025, registered at Police Station Rajgarh, District Sirmour, H.P., for the commission of offences punishable under Sections 341 and 324 of the Indian Penal Code (IPC) and consequential proceedings arising out of the said FIR based on the compromise effected between the parties. 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2 2026:HHC:21011 2. It has been asserted that the petitioner and the informant belong to the same family. They have settled the matter with the intervention of their elders and family members. They want to maintain peace and good relations. No fruitful purpose would be served by continuing with the present proceedings. Hence, the petition. 3. Statement of the informant/victim, Babu Ram, was recorded on 17.4.2026, in which he stated that he had entered into a compromise with the petitioner/accused voluntarily without any influence from any person, and he had no objection in case the FIR is ordered to be quashed as per the compromise. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. The offence punishable under Section 341 of the IPC is compoundable under Section 320 of Cr. P.C. The Hon’ble Supreme Court held in Suraj Singh Gujar v. State of M.P., 2024 SCC OnLine SC 2414 that the conviction recorded for the commission of an offence punishable under Section 324 of IPC can be quashed by taking recourse to Section 482 of Cr.P.C. Latest HLJ 2022(HP) (1) 759 and Rukam Deen Vs State of Himachal Pradesh 2023(1) Him. L.R.(HC) 616 based on the compromise. These judgments are binding on this Court. 6. In view of these binding precedents, the present petition is allowed, and FIR No. 26 of 2022, dated 15.2.2022, registered at Police Station Rajgarh, District Sirmour, H.P., for the commission of offences punishable under Sections 341 and 324 of IPC and consequential proceedings pending/initiated against the petitioner-accused in pursuance thereof are also ordered to be quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8.
