Petitioner was an employee of West Bengal Transport Corporation Limited, who retired on superannuation on 31st December, 2020. 3. It is submitted on behalf of the petitioner that after superannuation petitioner was paid provident fund, gratuity and leave salary belatedly. Petitioner has prayed for releasing interest on provident fund, gratuity and leave salary which were not paid on the date of retirement of the petitioner. 4. West Bengal Transport Corporation Limited is represented by learned advocates. 5. Learned advocate representing the Corporation has opposed this writ petition on the ground of delay as petitioner retired on superannuation on 31st December, 2020 whereas present writ petition was filed in 2025. 2 6. The point of delay in the matter of giving direction to grant interest on retiral dues in case of retired employees of West Bengal Transport Corporation is decided in WPA 15061 of 2025 (Roshan Lal v. The State of West Bengal & Ors.). Therefore, there is no need to dilate on this issue. 7. Since it is found that West Bengal Transport Corporation caused delay in releasing retiral dues, said authority is directed to pay interest at the rate of 6 per cent per annum on leave salary, gratuity and provident fund dues from the date following the date of retirement till the date of payment of those amounts within a period of three (3) months from the date of communication of this order. 8. In the event concerned respondent authority fails to pay interest on retiral dues in terms of the aforesaid directions within the stipulated time, respondent authority shall be required to pay 8 per cent interest per annum on deferred payment. 9. With the aforesaid directions writ petition stands disposed of. 10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
