PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: These two Criminal Revision Cases are heard together and are being disposed of by this common order, as the Petitioners in the two cases are different, but the crime registered against them is one and the same. 2. These two Criminal Revision Cases have been filed under Sections 397 read with 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘the Cr.P.C.,’)/Sections 438 read with 442 and of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), challenging the common order dated 23.06.2026 passed by the learned Judicial Magistrate of First Class, Sathyavedu in Crl.M.P.Nos.2953 & 2243 of 2026 in Crime No.32 of 2025 of 4 Varadaiahpalem Police Station, whereby the Petitioners sought release of the properties for interim custody. 3. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 4. The learned Magistrate had allowed the petitions for sending the material objects for FSL examination. However, the petitions seeking return of custody of the property to the Petitioners were dismissed. The learned Magistrate observed that the Petitioners were at liberty to file a petition after obtaining the FSL report or after filing of the Charge Sheet by the police. 5. On perusal of the record, there are no material irregularities apparent on the face of the record. The Petitioners are required to await either the filing of the FSL report or the Charge Sheet. If the material objects sought by the Petitioners are released to interim custody at this stage, the investigation would be delayed and derailed. 6. In view of the above, these two Criminal Revision Cases are disposed of, granting liberty to the Petitioners to renew their applications after the FSL report is filed or the Charge Sheet is filed. There shall be no order as to costs. As a sequel, interlocutory applications, if any pending, shall stand closed. _________________________ Dr. Y.
