Saikia, learned counsel for the petitioner. Also heard Ms. H. Terangpi, learned standing counsel, Secondary Education, Assam. The petitioner in the present writ petition has presented a challenge to the order dated 07-02-2026 issued by the Director, Secondary Education, Assam allowing the jurisdictional Inspector of Schools to hold the charge of the post of Head Master of Milan High School, Bargacha, Nalbari. The petitioner has projected in the writ petition that he is the senior-most teacher in the School possessing all requisite eligibility criteria for promotion to the post of Head Master in any provincialized Secondary School in the State. It is also projected that a vacancy having arisen in the School on the incumbent in the said post retiring, therefrom, on 31-01-2026, it was the petitioner who was to be allowed to hold the charge of the post of Head Master of the School in view of his seniority, therein. The learned standing counsel, Secondary Education, Assam had earlier projected before this Court that as there was an enquiry pending against the petitioner with regard to certain allegation raised against him, the petitioner was not permitted to hold the charge of the post of Head Master of the said School and the jurisdictional Inspector of Schools was permitted to hold the charge. Today, Ms. H. Terangpi, learned standing counsel, Secondary Education, Assam, has placed on record an order dated 22-07-2026 issued by the Director, Secondary Page No.# 3/3 Education, Assam. A perusal of the said order would go to reveal that on conclusion of the enquiry conducted against the petitioner, the allegations levelled against him were found to be false. Accordingly, the Director, Secondary Education, Assam vide the said order dated 22-07-2026 has permitted the petitioner to hold the charge of the post of Head Master of Milan High School, Bargacha, Nalbari along with financial power to draw and disburse the salaries of the staff, in addition to his normal duties as a Graduate Teacher, invoking the provision of FR-49(C) of FR&SR. In view of the issuance of the order dated 22-07-2026 permitting the petitioner to hold the charge of the post of Head Master of the School in question, the grievance raised by the petitioner in the present writ petition stands redressed. There being no further live issue existing for consideration in the matter, the present writ petition stands closed in terms of the order dated 22-07-2026 issued by the Director, Secondary Education, Assam, allowing the petitioner to hold the charge of the post of Head Master of the School in question. A copy of the order dated 22-07-2026, furnished by Ms. H. Terangpi, is kept on record, marked as ‘X’, for the purpose of identification. JUDGE Comparing Assistant
