Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 310(2) of B.N.S and 27 of the Arms Act in connection with Gopikander PS Case No. 23 of 2025.

Learned counsel appearing for the petitioner submits that though this is a case of dacoity, but nothing has been recovered from the possession of the petitioner and he has been falsely implicated in this case. Learned counsel submits that the petitioner has been made accused on the basis of confessional statement of co-accused and he was neither placed in T.I Parade nor identified and he is in custody since 19.07.2025.
Learned counsel further submits that though charge-sheet has been submitted in this case but there is no progress in the trial. As such,
learned counsel for the petitioner submits that petitioner may be enlarged on bail.

Learned APP opposes the prayer for bail of the petitioner.

Having regard to the aforesaid facts and circumstances of the case it appears that charge-sheet in this case has been submitted on

27.09.2025 coupled with the fact that the petitioner is in custody since 19.07.2025 and there is no likelihood of early conclusion of the trial, I am inclined to enlarge the petitioner, above-named, on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned J. M. 1st Class, Dumka in connection with Gopikander PS Case No. 23 of 2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

Accordingly, the instant bail application stands allowed.
