1. The petitioners, through the medium of this petition, have challenged order of demolition passed under Section 253 (1) of the Jammu & Kashmir Municipal Corporation Act, 2000 directing to remove the violations within 07 days from the receipt of notice failing which, same shall be demolished by JMC, at their risk & Costs.
2. Learned counsel for the respondents submits that he has instructions from the respondents who are in the process of withdrawing the impugned order Serial No. 114
2 WP(C) No. 353/2026
and shall pass a fresh order having regard to the direction passed in WP(C) No. 290/2026 titled M/s Ellora Exclusive and anr. Vs. Jammu Municipal Corporation & Ors, whereby certain directions have been passed by the Co- ordinate Bench of this Court.
3. In view of the submissions made by learned counsel for the respondents, no further proceedings are required in this case.
4. The petition is, accordingly, dismissed as having been rendered infructuous. However, the respondents shall await for the response to be filed by the petitioners for a period of one week from the date of passing of this order before passing of fresh orders.
5. Disposed of, accordingly, along with connected application(s).
