This is an application under Section 482 of the BNSS, 2023 for praying for granting pre-arrest bail to the accused applicant Abhayapuri P.S. Case No. 57/2025 Page No.# 2/2 under Sections 318(4)/316(2)/ 303(2) of the BNS, 2023 read with Sections 66(C)/66(D) of the IT Act, 2000. 3. Vide order dated 16.10.2025, a coordinate Bench of this Court has granted interim pre-arrest to the accused applicant. 4. Though the updated Case Diary was called for in the instant case, however, the same has not been produced even after the lapse of almost 9 (nine) months. On, as many as, 15 occasions, time was sought for production of the updated Case Diary. 5. Taking into account the aforesaid lapse on the part of the prosecution, this Court is of the considered opinion that the interim pre-arrest bail granted to the accused applicant vide order dated 16.10.2025 should be made absolute. 6. Accordingly, the instant anticipatory bail application stands disposed of by making the interim pre-arrest bail granted to the accused applicant, vide order dated 16.10.2025 absolute, on the same terms and conditions, as mentioned therein.
