WP No. 13032 of 2026 __________ Page2 of 4 2.This writ petition has been filed to forbear respondents 1 and 2 from interfering with the title dispute pertaining to patta No.1733 issued in respect of the property, morefully disclosed in the prayer to this writ petition, which is pending before the Civil Court. 3.The petitioner claims that due to the pendency of the civil suit, respondents 1 and 2 do not have the power to adjudicate the application filed by the third respondent seeking for cancellation of patta No.1733 issued in favour of the petitioners. 4.The petitioners have filed supporting documents along with this writ petition in support of their case that due to the pendency of the civil suit, respondents 1 and 2 cannot adjudicate the application filed by the third respondent to cancel the petitioners’ patta No.1733. This Court is not expressing any opinion on the merits of the same. 5.Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of respondents 1 and 2. Necessarily, the objections of the petitioners as raised in this writ petition will have to be considered by respondents 1 and 2 before adjudicating the third respondent’s application seeking for cancellation of patta No.1733 issued in favour of the petitioners.
The pendency of the civil suit between the parties will also have to be considered by respondents 1 and 2 while considering the third respondent’s application seeking for cancellation of patta No.1733 issued in favour of the petitioners. 7.For the foregoing reasons, this writ petition is disposed of by directing respondents 1 and 2 to consider the objections of the petitioners as raised in this writ petition, which includes the objections that due to the pendency of the civil suit pertaining to patta No.1733, respondents 1 and 2 cannot adjudicate the application submitted by the third respondent seeking for cancellation of patta No.1733 issued in favour of the petitioners.
