This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.405/2021 registered at Police Station Kota, District Bilaspur for the offences under Sections 457, 380 and 413 read with Section 34 of the IPC. 2. Case of the prosecution, in brief, is that the applicant herein along with other co-accused persons have stolen 27 quintals of rice and 7 SISTA SOMAYAJULU Digitally signed by SISTA SOMAYAJULU Date: 2026.01.19 18:16:46 +0530 (M.Cr.C.No.372/2026) quintals of sugar from a fair price shop and thereby committed the offence. 3. Learned counsel for the applicant submits that co-accused Bablu @ Laxminarayan has been granted bail and the applicant herein is in custody since 17-12-2025. 4. Learned State counsel opposes the bail application. 5. I have heard learned counsel for the parties and gone through the case diary. 6. Taking into consideration the nature and gravity of offence and considering that co-accused Bablu @ Laxminarayan has already been granted bail by this Court by order dated 8-10-2024 passed in M.Cr.C.No.6653/2024 and the incident is of 1-7-2021 and that no custodial interrogation of the applicant is required, I am of the considered opinion that it is a fit case to admit the applicant to bail. 7. Accordingly, the bail application is allowed. It is, therefore, directed that the applicant – Nilesh Jangde be released on bail on his furnishing a bail bond in the sum of ₹ 25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed, till the final disposal of trial.
