Case No. 54 of 2025 for the offences registered under Sections 115(2), 126(2), 109, 117(2), 3(5) of Bhartiya Nyaya Sanhita, 2023 and Section 3/4 of Prevention of Witch (Daain) Practices Act, pending in the Court of learned Judicial Magistrate, 1st Class, Garhwa, is pressed into motion. It is submitted by the learned counsel on behalf of petitioners that the offence under Section 109 of the BNS will not be made out as the injury alleged to be caused by this petitioner was on non-vital part of the body. It is also contended that there is no allegation of offence of Prevention of Witch (Daain) Practices Act and quarrel took place on trivial dispute of children and there has been delay of five days in lodging the FIR. Learned A.P.P. opposed the bail petition. It is submitted that the grievous injury was caused to the informant and her husband. Both hand of the husband of the informant got fractured and her husband’s head was also broken. Under the aforesaid facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner stands rejected.
