It transpires from the record that the applicant is in jail since 27.01.2025. Hence, the Court proceeds to consider and hear the bail application of the applicant with the assistance of the State counsel. 3. The applicant has preferred this Second Bail Application under Section 483 of the BNSS in connection with Crime No. 53/2025, registered at Police Station Simga, District Balodabazar-Bhatapara (C.G.) for the offence punishable under Sections 105 and 324(4) of the Bhartiya Nyaya Sanhita, 2023 and Section 185, 3/181 and 5/180 of Motor Vehicle Act. The First bail application of the applicant was rejected by this Court vide order dated 13.05.2025 in MCRC No.3783 of 2025 on mertis. 5. As per the prosecution story in brief, on 26.01.2025, at about 12:30 PM, a truck bearing registration No. CG 04/LJ-4330 dashed against the car of the complainant. Thereafter, the truck driver also hit a pedestrian and a motorcycle from behind, on which two persons were riding and proceeding ahead. Due to the impact, both persons fell down. Subsequently, the truck driver moved forward, crushing a woman who was a pillion rider, and dragged the motorcycle rider, as a result of which the said person also died. On the basis of the said incident, the complainant lodged an FIR bearing Crime No. 53/2025 for the offences as mentioned above. 6. Learned State counsel opposes the present (second) bail application and submits that, as a result of the accident, two persons died and two others were injured. She further submits that one of the injured persons has now succumbed to injuries, therefore, in view of the gravity of the offence, it is prayed that the bail application be rejected. 7. I have heard learned State counsel and perused the material available on record. 8. Considering the aforesaid facts and circumstances of the case, particularly that two persons died in the accident and one of the injured has subsequently succumbed to injuries, therefore, this Court is not inclined to grant bail to the present applicant, in view of the gravity of the offence. 9. Therefore, the bail application filed by the applicant/accused – Bhupendra Sahu @ Vakil involved in Crime No. 562/2024, registered 3 at Police Station Gudhiyari, District Raipur (C.G.) for the offence punishable under Sections 331(4), 305(1), 303(2), 3(5), 324(2), 238(b) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 10. Needless to say that the trial Court concerned, is at liberty to proceed and conclude the trial expeditiously. 11.
