JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 19.03 .2026 Heard Mr. A B T Hoque, the learned counsel appearing for the applicant. Also heard Mr. Bhaskar Sarma, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 430 of the BNSS, 2023 praying for suspension of sentence imposed upon the applicant as well as for allowing the applicant to go on bail during the pendency of the appeal. 3. The applicant Kiran Hazarika was sentenced to undergo rigorous imprisonment for 2 (two) years and to pay fine of ₹2,000/- (Rupees two thousand). In default of payment of fine, the applicant was sentenced to undergo rigorous imprisonment for another 30 days for commission of offence under Section 354 of the Indian Penal Code. The applicant was also sentenced to undergo rigorous imprisonment for 1 (one) year and to pay fine of ₹1,000/- (Rupees one thousand) and in default of payment of fine, he was sentenced to undergo rigorous imprisonment for another 15 days for commission of offence under Section 475 of the Indian Penal Code by the learned Sessions Judge Dhemaji in Sessions Case No. 13/2018. 4. After considering the submissions made by the learned counsel of both sides, it is Page No.# 3/3 hereby directed that the sentence imposed upon the applicant by the learned Sessions Judge, Dhemaji in Sessions Case No. 13/2018 shall remain suspended till disposal of the connected appeal. 5. The applicant Kiran Hazarika shall be released on bail of ₹50,000/- (Rupees fifty thousand) with a surety of like amount to the satisfaction of the learned Sessions Judge Dhemaji. 6.
