The instant writ application has been preferred by the petitioners praying therein for the following reliefs: For issuance of appropriate writ in form of certiorari for quashing of order dated 26.3.2020 passed by Respondent No.3 (which have been received online by the petitioner) whereby and whereunder the respondent No.3 in arbitrary manner opened Jamabandi in favour of the respondent No.4 over 3.5 decimals of land under Khata No. 106, Plot No. 606 situated in Mauza Lakhari, Thana No.101, Giridih without cancelling the ongoing Jamabandi of the petitioner No.1 and without giving opportunity of hearing the petitioner No.1 before passing the impugned order; And For issuance of an appropriate writ for quashing the order dated 12.7.2021 passed in Mutation Case No. 3771/2020-2021 passed by the Sri Ravi Bhushan Prasad, the-then Circle Officer, Giridih as contained in Annexure-7, whereby and where under Mutation of the land of Khata No. 106, Plot No.606, area 4 decimals has been done in favour of Meera Kumari wife of Arun Kumar in most arbitrary manner even without taking into consideration that earlier Mutation Case No. 2708 R27/2019-2020 for mutation of aforesaid land was rejected on 12.3.2020, but during the pendency of instant writ application Mutation Case No. 3771/2020-2021 has been allowed; 2026:JHHC:9218 2 3. After some argument, learned counsel for the petitioners submits that the instant writ application may be disposed of by giving liberty to the petitioners to file a suit before the civil court of competent jurisdiction. 4. There is no objection from the respondents. 5. Accordingly, the instant writ application stands disposed of with the liberty as prayed for. 6. It is made clear that this Court has not given any finding with regard to right title and possession as prayed in the instant writ application. 7. Pending I.A., if any, also stands closed.
