JUSTICE YARENJUNGLA LONGKUMER ORDER 23.07.2026 The instant application has been filed by the applicant/claimant who is the respondent in MACApp.3/2023. The learned counsel for the applicant Mr. Imtiwapang submits that by order dated 11.12.2023, passed in I.A (Civil) 130/2023, this Court had directed the appellant to deposit 50% of the awarded amount with the Registry of this Court. It is Page No.# 2/3 submitted that the said order has been complied with by the appellant/Insurance Company and the 50% of the awarded amount has been deposited in the Registry of this Court on 30.01.2024. It is also stated that after hearing the parties, MACApp.3/2023 filed by the appellant/Insurance Company has been dismissed by judgment and order dated 18.08.2025. However, in the judgment dated 18.08.2025, this Court has not made any observation regarding the 50% awarded amount which is lying with the Registry. Accordingly, it is prayed that the claimant/applicant may be allowed to withdraw the 50% of the awarded amount of Rs.10,25,500/- deposited on 30.01.2024. This Court has considered the submission of the learned counsel for the applicant and perused the order dated 18.08.2025 passed in MACApp.3/2023. It is seen that the appeal preferred by the National Insurance Company has been dismissed by the said judgment and order. The compensation awarded to the claimant was modified to Rs.16,62,200/- to be paid to the claimant at the rate of 7.5% interest from the date of filing the claim petition i.e., 30.09.2019. This Court has also perused the order dated 11.12.2023 passed in I.A(Civil) 130/2023 arising out of MACApp.3/2023. By order dated 11.12.2023, this Court directed the appellant to deposit 50% of the awarded amount before the Registry of this Court on or before 30.01.2024. Accordingly, the appellant had deposited 50% of the awarded amount before the registry of Page No.# 3/3 this Court on 30.01.2024. In view of the dismissal of MACApp.3/2023 by order dated 18.08.2025, Registry is directed to release the 50% of the awarded amount deposited by the appellant to the claimant/applicant after proper verification and identification by the learned counsel for the applicant/claimant.
