Learned counsel for the petitioner submits that the notice in respect of No Confidence Motion has not been served by the appropriate Authority and it has been served through the concerned Chief Executive Officer, therefore, the notice is not in accordance with law, as such, on the basis of said notice, No Confidence Motion
3 can be initiated against the petitioner. Hence, it is prayed that impugned notice Annexure P-1 be set-aside. 2. Learned counsel for the respondent/State as well as learned counsel for the Caveator submit that notice has been issued and served upon the petitioner in accordance with law within prescribed time. Alongwith the caveat, certain documents has been filed showing that out of 10 members, 09 members (Panchas) have filed an application for motion of ‘No Confidence Motion’ against the petitioner, based upon which, on 15.04.2026 resolution has been accepted by the concerned SDO, as such, the instant petition is devoid of merits and liable to be dismissed. 3. Heard learned counsel for the parties and perused the writ petition including the documents available on record. 4. Considering facts of the case, nature of relief, submissions of counsel for the parties, particularly the fact that 07 days notice has been give to the petitioners and there is no any illegality or infirmity, further considering that out of 10 members, 09 members have filed an application for motion of ‘No Confidence Motion’ against the petitioner, therefore, the instant petition fails as there is no ground to interfere with the proceedings. 5. Accordingly, writ petition is hereby dismissed. Sd/-
