AG/GA Mizoram for R 1-5 BEFORE HONORABLE MRS. JUSTICE SHAMIMA JAHAN ORDER 24.07.2026 Heard Mr. Victor L. Ralte, learned counsel for the applicant. Also heard Mrs. Vanneihsiami, learned Govt. Advocate for the State and Mr. Kartik Jain, learned counsel for the respondent No. 7. By this Interlocutory Application, the applicant has raised the issue that after the interim order was passed in the present case, the respondents have acted in violation thereof. He submits that an interim order was passed in the main writ petition i.e., WP(C) No. 65/2026, wherein it was directed that no disbursement of compensation should be done to the land owners, for acquisition of their land for construction of the road, without taking liberty of this Court and the said order was passed on 03.07.2026. However, the learned counsel for the petitioner submits and has placed a notification dated 17.07.2026 issued by the competent authority for land acquisition (NH-06) i.e., Cala and Additional Deputy Commissioner, Aizawl District, Mizoram, requesting 19 land owners mentioned therein, to bring their xerox copy of Aadhar Card, Page No.# 4/4 Voters ID, Pan Card, Bank Passbook and original land passes for the purpose of getting the compensation with regard to their land being acquired for construction of the road. The learned counsel for the petitioner submits that the documents have been asked from the said land owners and at any point of time, the compensation can be disbursed to them before the settlement of dispute between the petitioner and respondent No. 8 which is pending before the Inter- Village Boundary Dispute Committee. However, it is seen that in the said interim order passed in the instant case that disbursement is directed to be paid, only after taking leave of this Court. However, the public notice that has been placed by the learned counsel for the petitioner has not mentioned about disbursement of money to the said land owners. As such, there is no violation of the interim order, as such. Be that as it may. However, it is further reiterated that no disbursement of compensation amount should be done to the land owners, without taking leave of this Court pursuant to the notice dated 17.07.2026 mentioned above.
