By way of this Writ Petition, the petitioner is seeking indulgence of this AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.03.19 11:23:55 +0530 2 Court as he is aggrieved by the act of respondent authorities declaring the petitioner as ‘disqualified’ for appointment on the post of Assistant Teacher (Trained) and since the petitioner has acquired his graduate degree in B.A .B.Ed (integrated course) which is not valid as per Kendriya Vidyalaya Sangathan Recruitment norms. 2. Petitioner has sought following reliefs:- 10.1 To kindly direct the respondent authorities to consider the case of the petitioner for appointment on the post of Teacher. 10.2 To kindly direct the respondents to issue the appointment order in favour of the petitioner and providing him all consequential benefits including seniority as per his merit position in the selection list. 10.3 To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case. 3. At the outset, learned counsel for respondent/Union of India submits that the petitioner already has an alternative remedy to approach the Central Administrative Tribunal raising his grievance which has been raised in the present petition, as such, this Petition is not maintainable. 4. Counsel for the petitioner would not dispute the aforesaid submission and seeks permission of this Court to withdraw this petition with liberty to file a petition before the concerned Central Administrative Tribunal raising his grievance. 5. In view of the submissions made by the parties, this Writ Petition is 3 dismissed as withdrawn while granting liberty as prayed for by the petitioner to approach the concerned Central Administrative Tribunal. 6. The concerned CAT is directed to consider the issue of limitation etc., if arises in this case, taking in view of the fact that this petition is pending before this Court since 08.08.2023.
