In this petition, petitioners have sought for appointment of an Arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996 for resolution of dispute - 3 - HC-KAR NC: 2026:KHC:17397 CMP No. 510 of 2025 by referring to Clause 22 of the Partnership Deed dated 16.01.2024 produced at 'Annexure-A' to the petition. 3. Learned counsel appearing for the respondent, referred to the suit filed by the petitioners herein before the Prl. Civil Judge and JMFC, Channapatna, in O.S.No.317/2024. 4. Having taken note of the submission made by the learned counsel appearing for the parties, it is not in dispute that the petitioners herein have filed memo seeking withdrawal of the suit. 5. Taking into consideration the provision has been made for resolution of dispute by an Arbitrator as per Clause 22 of the Partnership Deed dated 16.01.2024 at 'Annexure-A', I am of the view that Sri.Radhakrishna Holla K., the retired District Judge be appointed as an Arbitrator for resolution of dispute. 6. A copy of this order be sent forthwith to the Arbitration and Conciliation Centre, Khanija Bhavan, Bengaluru, for proceeding further in the matter. 8. Since the parties are represented through their learned counsel, in order to avoid further delay in the matter, the parties are directed to appear before the Arbitration and Conciliation Centre on 24.04.2026 at 11.00 a.m., without waiting for further notice in this regard.
