Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioners seeking following reliefs :- [ 10.1 That, this Hon’ble Court may kindly be pleased to call the relevant records from the respondents with regard to construction of canal and access road between the Chandani Chowk to Rajmahal at District -Raigarh (CG) 10.2 That, this Hon’ble Court may kindly be pleased to issue writ / writs / order / direction to the respondents to providing an alternative land which is adjacent land area 798 hectare from the part of land bearing sheet no. 56, plot no. 127/6 to the petitioners in case of acquisition of their land and the petitioners bearing sheet no. 56, plot no. 127/6 area 798 hectare which is situated Chandani Chowk Raigarh. 10.3 That, this Hon’ble Court may kindly be pleased to issue writ/writs/order/direction to the respondents to do not take any coercive steps against the petitioners till deciding the application of petitioners (Annexure P-5). 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit. 2. Learned counsel appearing for the petitioners submits that petitioners are in possession of Nazul land bearing sheet No. 56, plot No. 127/6, area 798 sq.ft. situated at Chandani Chowk, Raigarh (C.G.). Patta (Annexure P-2) was granted in their favour vide order dated 22.03.2022 in respect of aforesaid land. However, respondents intended to widen the road from Chandani Chowk to Rajmajhal (Raigarh)and construct a canal. Said land of petitioner also come in the area of aforesaid activity to be taken out by the respondents, therefore, the petitioners have preferred an application (Annexure P-5) dated 24.11.2025 before respondent No. 2/Collector, Raigarh to provide them alternative land in lieu of aforesaid land, 3 but the same has not been decided yet. Hence, learned counsel for the petitioners submits that this petition may be disposed of directing respondent No. 2 / Collector, Raigarh to decide application (Annexure P-5) dated 24.11.2025 filed by the petitioner within a specific time frame. 3. Learned counsel for the State submits that application (Anneure P-5) dated 24.11.2025 is under consideration and the same shall be considered and decided in accordance with law. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer made by counsel for the petitioner and the contention putforth by Counsel for the State, this petition is disposed of directing respondent No. 2 / Collector, Raigarh (C.G.) to decide the application dated 24.11.2025 (Annexure P-5) filed by petitioners expeditiously preferably within a period of of 30 days from the date of receipt/ submission of copy of this order. 6. With the aforesaid observation & direction, this petition is disposed of. 7. Pending interlocutory application, if any, stands disposed of.
