Baruah, learned counsel for the petitioner. Also heard Mr. A.K. Ghosh, learned standing counsel, P&RD Department, Assam appearing for the respondents. The petitioner in the present writ petition has presented a challenge to an order of transfer dated 13-07-2026 by which the transfer ordered in respect of the petitioner and one another was modified. Mr. Ghosh submits that in the event this Court proceeds to consider the contention of the petitioner and interfere with the order dated 13-07-2026, the same would have the effect of disturbing the transfer and posting of one Saiful Islam who, however, is not made a party respondent in the present writ petition. In view of the above submission of Mr. A.K. Ghosh, learned standing counsel, P&RD Department, Assam, Ms. S.G. Baruah, learned counsel for the petitioner submits that she be permitted to withdraw the present writ petition with liberty to re-file the same after rectifying the error noticed, hereinabove.
