The petitioner has filed this writ petition seeking following reliefs:- “10.1 That the Hon'ble Court may kindly be pleased to call for the records of the case from the respondents. 10.2 That, this Hon’ble Court may kindly be pleased to issue writ of mandamus or any other writ/writs, order/orders or direction/directions to the Respondent No. 2 to decide the representation of the petitioner within stipulated time limit. 2 10.3 That, this Hon’ble Court may kindly be pleased to direct the Respondent No. 2 to verify the suitability of petitioner and if found fit in order on merit, then immediately issued order of appointment on the post of Surveyor in favour of petitioner. 10.4 Any other relief//relief’s which Hon’ble Court may deem fit in the facts and circumstances of the instant case. ” 2. Learned counsel for the petitioner submits that petitioner pursuant to the advertisement dated 04.10.2023, submitted his application for appointment on the post of Surveyor. He contended that after the completion of the recruitment proceedings, name of the petitioner was mentioned at Serial No. 55 in select list. Initially, appointment order was issued to 54 candidates above the petitioner. Subsequent to the joining, one of the candidate, out of the 54 candidates namely, Kunal Vyas have left the job and therefore, the said post became vacant. After getting knowledge about the vacancy, petitioner submitted representation before Respondent No. 2 on 10.12.2025 and 12.03.2026, however, till date, none of the representations have been considered and therefore, direction be issued to the concerned authority to consider and take decision on the pending representations at the earliest within specified time frame. 3. On the other hand, learned counsel for the respective respondents would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 2 to consider and take decision on the representations, they are having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of directing the Respondent No. 3 2 to consider and take decision on the representations (Annexure P/7) submitted by the petitioner in accordance with law, expeditiously, preferably within a period of 02 months from the date of receipt of order. 6.
