Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with R. Udayagiri P.S. Case No.155 of 2021 corresponding to G.R. Case No.133 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, Gajapati at Paralakhemundi on the grounds stated. 3. Perused the FIR as at Annexure-1. A copy of the chargesheet is filed and the same is gone through. It is made to reveal from chargesheet that large area was under illegal cultivation of cannabis plants. The details of the inspection at the spot leading and destruction of the cannabis plants has been mentioned in the FIR. The name of the petitioner is also therein with others. Since there is allegation against the petitioner, whose name along with one Nabin Mandal is revealed, recording the objection of the State, this Court is not inclined to consider grant of pre-arrest bail to him, however, is of the view that he is at liberty to surrender before the court below seeking regular bail for being considered on merit. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction to the petitioner to surrender before the court of learned Sessions Judge-cum-Special Judge, Gajapati at Paralakhemundi within a fortnight from today in connection with R. Udayagiri P.S. Case No.155 of 2021 corresponding to G.R. Case No.133 of 2021 and upon receiving an application for bail from him, it shall be disposed of on the very same day regarding being had to all such plea advanced at present. 6.
