GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- <…to issue a Writ or order more particularly one in the nature of writ of Mandamus declaring the action of the 3rd respondent in illegally interfering with the Petitioners peaceful life and liberty and harassing and threatening the Petitioners inspite of complying with Sec 41A Cr PC Sec 353 BNSS Notices issued in Crime No 17 of 2026 pursuant to the orders of this Honble Court in CrI P No 1244/2026 dated 17 2 2026 by continuously calling the Petitioners to the police station and threatening of arrest by foisting some more false cases as illegal arbitrary without jurisdiction and violative of Article 21 of the Constitution and further direct the respondents not to interfere with the Petitioners respective personal life and liberty and pass such order(s).= 2. Heard the learned Counsel for the Petitioners and the learned Assistant Government Pleader for Home. 3. Sri Kona NDV Ramana, learned counsel for the Petitioners, submits that the Petitioners are being unnecessarily called to the police station and made to sit for hours together, despite having been served with notice contemplated under Section 35(3) of the BNSS. 3 Dr.YLR, J Crl.P.No.10602 of 2026 Dated 21.04.2026 4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, submits that the police have neither called the Petitioners to the police station unnecessarily nor made them sit for hours together. 5. Considering the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of with a direction to the Respondent Police not to call the Petitioners to the police station unnecessarily or make them sit for hours together without conducting any investigation with respect to their alleged role in the case. The Petitioners shall cooperate with the Investigating Officer for smooth conduct of the investigation. There shall be no order as to costs.
