Sharma for the applicant Sanjay Prasad Singh @ Sanjay Mahato who has filed this application under Section 5 of the Page No.# 2/2 Limitation Act, 1963 with prayer for condonation of delay of 85 days in preferring the connected criminal appeal against the Judgment and Order dated 19.12.2025 passed by the learned Sessions Judge, Sonitpur, Tezpur in Session Case No. 120/2018, convicting the applicant under Sections 326/34 IPC and sentencing him to undergo RI for 5 years and to pay fine of Rs.10,000/- and under Section 307/34 IPC to undergo RI for 10 years and to pay fine of Rs.20,000/- i/d RI for one year. The sentences are to be served concurrently. 2. Learned Addl.Public Prosecutor Mr.P.S. Lahkar is present for the State respondent No.1. 3. It is submitted that the present applicant is behind bars and he was unable to engage any lawyer. He submits that except his mother, there are no family members to consult a lawyer. 4. I have considered the submissions at the Bar with circumspection. Sufficient grounds have been assigned. No malafide is discernable.
