Gill, AAG assisted by Ms. Shikha Sharma, AAAG, Mr. Surya Prakash [2026:RJ-JP:28377-DB] (2 of 3) [CW-7599/2020] HON'BLE MR. JUSTICE ARUN MONGA HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order(Oral) 23/07/2026 Per: Arun Monga, J. 1. The writ petition has been filed more than five years ago, sometime in the year 2020, seeking to quash the delimitation notification dated 19.09.2019 issued by the Department of Local Bodies, Government of Rajasthan, i.e., respondent No. 1, whereby the number of municipal wards was increased from 30 to 40. 2. Inter alia, the allegation of the petitioner is that the aforesaid notification was issued in violation of the provisions of the Rajasthan Municipal Act, 2009, read with the applicable rules. It is also averred by the petitioner that the requirement to conduct the delimitation within the existing notified municipal boundaries was contemplated without considering the objections which were filed by the petitioners, and thus the notification is liable to be quashed. 3. Learned counsel for the respondents submits that the subsequent notification dated 22.04.2025, issued by the competent authority of the State Government, supersedes the earlier notification dated 19.09.2019 under challenge before this Court. In the premise, the said exercise is now not only academic in nature but also a complete futility, he contends. 4. Having noted as above, we do not deem it appropriate to advert to the merits of the aforesaid notification dated 19.09.2019, as the same has, by efflux of time, become an academic exercise. [2026:RJ-JP:28377-DB] (3 of 3) [CW-7599/2020] 5. Confronted with the aforesaid, learned counsel for the petitioner seeks to withdraw the instant petition with liberty to challenge the subsequent notification. 6. He may do so, in accordance with law. 7. With the aforesaid liberty, the instant writ petition stands disposed of. 8. All pending applications stand disposed of.
