The petitioner, above-named, who is in custody in connection with Gamharia (Saraikella) P.S. Case No. 117 of 2025 for the offence registered under Sections 126 / 109/ 118/ 3(5) of BNS, 2023 and Section 27 of the Arms Act has prayed for regular bail. It is submitted by the learned counsel on behalf of petitioner that it was a case of drinking brawl as the informant and the accused persons were alleged to be sitting together. It is submitted that there is no specific allegation against the petitioner and the allegation of firing is against the co-accused, Rishu Thakur and not against him. It is further submitted that similarly situated co-accused person has already been enlarged on bail by the Co-ordinate Bench of this Court. Learned A.P.P. for the State while opposing the prayer for bail has not disputed the factual assertions. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
