Petitioner has filed this Writ Petition seeking following reliefs:- 10.1 That, this Hon'ble Court may kindly be pleased to call for entire records pertaining to the case of petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ in nature of mandamus whereby to quash/set aside the impugned the fit list dated 23.09.2022 issued by the Respondent No. 3 (Annexure P/1) as well as the Order dated 25.11.2022 3 issued by the Respondent No. 4 (Annexure P/2). 10.3 That, this Hon'ble Court may kindly be pleased to issue a writ in nature of mandamus whereby to direct the Respondent No. 2 and 3 to issue new joint fit-list for promotion from the post of Head Constable (M.T.) and Head Constable (Mechanical) to the post of Assistant Sub Inspector (M.T.) looking to the seniority of the Petitioner as Head Constable (M.T.) of the batch of Year 2012. 10.4 That, this Hon'ble Court may kindly be pleased to issue a writ in nature of mandamus whereby to direct to the Respondent No. 2 and 3 to replace those Head Constable (M.T.) who do not possess the certificate of fiter-Course but their names have been found eligible in the fit-list of the year 2022 for promotion to the post of Assistant Sub-Inspector (M.T.) and who are junior than the petitioner as they belong to the batch of 2013. 10.5 That, any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case. 2. Counsel for the petitioner submits that identical petitions are pending for adjudication with the regard to the addition of names of similarly situated persons in the fit list for promotion which has been challenged before this Court and decision is yet to come in 4 those petitions and such, he seeks to withdraw this petition with liberty to file a fresh petition for grant of similar relief in case any exigency arises. 3.
