ORDER: This writ petition is filed to declare the action of the respondents in not paying bill amounts towards the cost of material supplied and skilled and semi-skilled labour engaged by the petitioner for execution of the works i.e., i) work ID. No. 077041515010080060 for an amount of Rs. 5,88,657/-, ii) work ID. No. 077041515010080061, for an amount of Rs. 3,67,868/-, iii) work ID. No. 077041515010080062 for an amount of Rs. 4,96,339/-, iv) work ID. No. 077041515010080056 for an amount of Rs. 3,93,952/-, v) work ID. No. 077041515010080- 055 for an amount of Rs. 4,69,849/- and vi) Work ID. No. 077041515010080054 for an amount of Rs. 3,79,793/- (total amount of Rs. 26,96,458/-), as illegal, arbitrary and consequentially, direct the respondents to pay the above amounts forthwith along with interest at the rate of 12% per annum to the petitioner. 02. It is the contention of the petitioner that even though the respondents admit that the petitioner is entitled to the aforesaid. amount, no payment has been made. The petitioner further contends that such non-payment of money is clearly arbitrary and high-handed, requiring interference of this Court. 03. On the other hand, learned Assistant Government Pleader for Gram Panchayat and Rural Development, while admitting about the claim of the petitioner, placed on record a copy of written instructions received from the respondent No. 5 vide Lr. Rc.No. A4 / Court Case / IN WP NO.24512 / 2026, dated 05.09.2026, stating that time is required for payment of bills for Rs.20,18,222/-. 3 BSB,J W.P.24512 of 2026
04. The learned counsel for the petitioner requested to pass appropriate order for the payment of the amount admitted in the written instructions. 05.
In view of the submissions made on both sides, the writ petition is disposed of, directing the respondents to pay an amount of Rs.20,18,222/- (twenty lakh eighteen thousand two hundred twenty two rupees only) to the petitioner, along with the interest, if any, at the rate entitled, within a period of two (02) months from the date of receipt of a copy of this order. It is open to the petitioner to agitate the claim for higher rate of interest, if any, payable by the respondents, before an appropriate forum. There shall be no order as to costs.
